IMMIGRATION AND CITIZENSHIP:

If you have no legal documents to stay in the United States permanently, you may apply for lawful permanent residence based on the following, among others:

  1. Marriage to a United States citizen
  2. Petition from a United States citizen child or other immediate relatives
  3. Petition from a sponsoring employer as an alien with extraordinary abilities
  4. Self-Petition as an alien with extraordinary abilities with or without a National Interest Waiver based on submission of clear and convincing evidence or sufficient evidence as the case maybe
  5. Petition as an Alien Entrepreneur with an investment risk of at least $1 million anywhere in the United States or lower in certain targeted areas
  6. Application for Asylum and when asylum is granted, asylee is eligible to apply for a Green Card after one year

If you are holding a non-immigrant visa to the United States and want to change it to another, here are the possible options, among many others:

  • J-1 to F-1
  • F-1 to H-1B
  • H-1B to EB-1, 2, 3, 4, or 5
  • B-1/B-2 to F-1 or J-1
  • L-1 to EB-3
  • O-1 to EB-3 subject to visa availability
  • P-1 to EB-3 subject to visa availability

If you want to be a Naturalized U.S. citizen, here are the basic requirements:

  • You must have been a lawful permanent resident for at least 5 years with at least 2.5 continuous presence in the United States, possess good moral character, and pass the English language and Civics test unless exempt from such tests.

If you want expedited naturalization, you must prove that you are enlisted in the U.S. Military for at least a year with a Green Card.

You can receive a Certificate of Citizenship if you are below 15 years of age and born to a U.S. citizen parent.

RELIEFS FROM REMOVAL/DEPORTATION

If you are under a final order of removal or deportation, your particular case may be applicable to filing the following reliefs on a case to case basis:

  1. Voluntary Departure: Upon receipt of the Immigration Judge’s removal order, you may request immigration judge to issue a Voluntary Departure Order instead of Order to Remove. Signing the document is tantamount to avoiding the stigma of having been forcefully departed to a country of birth.
  2. Cancellation of Removal and Application to Adjust Status: If you have continuous physical presence in the United States 10 years after arrival submit all documents related to physical presence starting from the first year of arrival; possess good moral character; has a qualified relative in the U.S. (US citizen spouse , children, or parents who would suffer exceptionally and unusually extreme hardship if removed to country of origin.)
  3. Suspension of Deportation: If you have continuous physical presence for 7 years before the filing of an immigration benefit
  4. Motion to Terminate Removal Proceedings subject to prescribed grounds, as per the Morton Memo on Prosecutorial Discretion
  5. Application for a Waiver of Grounds of Inadmissibility under Sec. 212(I)
